Agreement to These Terms

These Terms of Service govern your use of masmcreations.com (the "Site"), operated by MASM Creations ("we," "us," or "our"). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

What This Site Is

The Site presents information about our creative services, portfolio work, and publications. Nothing on the Site is an offer or a binding commitment to perform work. Client engagements are governed by a separate written agreement or signed proposal.

Use of the Site

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to the Site, its servers, or related systems.
• Interfere with or disrupt the Site's operation, security, or availability.
• Scrape, harvest, or collect information from the Site for the purpose of unsolicited contact.
• Reproduce, republish, or resell Site content without our written permission.

Intellectual Property

All content on the Site — including text, images, video, artwork, design, and code — is the property of MASM Creations or its licensors and is protected by copyright and other intellectual property laws. Portfolio work is displayed with the permission of the relevant client where applicable.

Product names, logos, and brands of third-party tools referenced on the Site remain the property of their respective owners. Reference to any tool does not imply endorsement or affiliation.

Client Work and Separate Agreements

Any project undertaken for a client is governed by a separate written agreement covering scope, fees, timeline, revisions, ownership of deliverables, and cancellation. Nothing on this Site modifies or replaces that agreement.

AI-Assisted Work

We use AI tools as part of our creative and production process. All AI-assisted work is reviewed by a human before delivery. AI platforms are third-party services whose availability, pricing, and capability may change without notice, and we are not responsible for such changes. See our Disclaimer for more.

No Warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on it is accurate or complete.

Limitation of Liability

To the fullest extent permitted by law, MASM Creations and Michael Matica shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site, including lost profits or business interruption, even if advised of the possibility of such damages.

The Site may link to third-party websites. We do not control and are not responsible for their content, policies, or practices. Visiting a linked site is at your own risk.

Governing Law

These terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles. Any dispute arising from these terms or your use of the Site shall be brought in the courts of Connecticut.
