By accessing masmcreations.com or engaging the services of MASM Creations, you agree to be bound by these Terms of Service. MASM Creations is owned and operated by Michael Matica, an independent creative services provider based in Connecticut.
MASM Creations provides AI-powered creative services including Website Design, Digital Art & Graphics, Video Creation, Branding & Visual Identity, Marketing & Ad Creatives, and AI Portraits & Custom Character Imagery. Specific scope, deliverables, timelines, and revision terms are defined in individual project agreements prior to commencement of work.
Creative services involve subjective interpretation and artistic execution. We cannot guarantee specific outcomes including but not limited to increased sales, brand recognition, audience engagement, or business growth. Results depend on your business environment, market conditions, how deliverables are used, and other factors outside our control.
Creative deliverables are provided for your use and direction. Nothing we provide constitutes legal, financial, investment, tax, or marketing strategy advice. Consult appropriate licensed professionals for such matters.
Project fees and payment schedules are communicated and agreed upon before work begins. No work commences without a signed project agreement and deposit where applicable.
Revision rounds are specified in your project agreement. Additional revisions beyond the agreed scope may be subject to additional fees. Discovery calls are free and may be cancelled at any time. For paid project engagements, cancellation and refund terms are specified in your project agreement. Work already completed and delivered is non-refundable. Cancellations must be submitted in writing to michael@masmcreations.com.
Your Materials: Brand assets, logos, photos, content, and other materials you provide remain your property. We will not use your materials beyond delivering your agreed project.
Completed Deliverables: Upon receipt of full payment, completed creative work product becomes your property as specified in the project agreement.
Portfolio Rights: MASM Creations retains the right to display completed work in its portfolio and marketing materials unless you request otherwise in writing prior to project completion.
Our Methods & Tools: Our creative methodologies, workflows, and proprietary processes remain the intellectual property of MASM Creations and are not licensed for resale or redistribution.
Some deliverables may incorporate AI-generated elements. By engaging our services, you acknowledge and accept the use of AI tools in the creative process. MASM Creations applies professional creative oversight to all AI-assisted work and is responsible for the final deliverable as described in your project agreement.
We treat all client project details, brand information, and business context as confidential. We will not disclose your project information to third parties without written consent, except as required by law.
To the maximum extent permitted by law, MASM Creations and Michael Matica shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of our services or creative deliverables. Our total liability shall not exceed fees paid for the specific project giving rise to the claim.
We use third-party AI and creative software platforms to deliver our services. We are not affiliated with or responsible for these tools. We do not receive commissions or referral fees for tool use unless explicitly disclosed.
These Terms are governed by the laws of the State of Connecticut. Disputes shall be resolved in the courts of Connecticut.
